Applicable Law. This site is created and controlled by RJM, in the Commonwealth of Virginia,
U.S.A. The laws of the Commonwealth of Virginia will govern these Terms and Conditions (without giving any effect to the principles of conflicts of laws) as such laws are applied to agreements entered and to be performed entirely within Virginia between Virginia residents. Any action to enforce these Terms and Conditions will be brought in the federal or state courts presiding in Virginia, U.S.A., and all parties expressly agree to be subject to the jurisdiction of such courts. RJM makes no representation that materials in this site are appropriate or available for use in other locations, and access to them from territories where any of the contents of this site are illegal is prohibited. If you choose to access this site from other locations, you do so on your own volition and are responsible for compliance with any applicable local laws.
General. In the event that any provision contained in these Terms and Conditions is held by a court of competent jurisdiction to be contrary to any law, the remaining provisions of these Terms and Conditions will remain in full force and effect. No joint venture, partnership, employment, or agency relationship exists between you and RJM, as a result of these Terms and Conditions or your use of this site. The waiver by RJM of one breach or default under these Terms and Conditions shall not constitute the waiver of any subsequent or other breach or default.

Your privacy is our concern and we want you to have a positive online experience while visiting the RJM site. We believe you should be informed about the information that is collected and greatly value your patronage and will honor our following commitment:

EU-US Data Privacy Framework Principles; Swiss-US Data Privacy Framework Principles. RJM complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. RJM has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF. RJM has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Independent Recourse Mechanism. In compliance with the EU-US DPF, the UK Extension to the EU-US DPF, and the Swiss-US DPF Principles, RJM commits to resolve complaints about our collection or use of your personal information. EU individuals with inquiries or complaints regarding our EU-US DPF, the UK Extension to the EU-US DPF, and the Swiss-US DPF policy should first contact RJM at: DPO@rjmgroupllc.com.
RJM has further committed to refer unresolved EU-US DPF, the UK Extension to the EU-US DPF, and the Swiss-US DPF complaints to JAMS, an alternative dispute resolution provider located in the United States. EU-US DPF, the UK Extension to the EU-US DPF, and the Swiss-US DPF FAQs. The following additional information is provided to address common concerns regarding the EU-US DPF, the UK Extension to the EU-US DPF, and the Swiss-US DPF protocols:
- To what type of third parties does RJM disclose personal information?
Answer: RJM does not disclose personal information to any third parties, however, RJM provides detailed health economics and outcomes information to the pharmaceutical industry to assist in establishing and defining product value. RJM accomplishes this by collecting and interpreting de-identified or anonymized patient and practice-specific information and evidence obtained directly from healthcare providers. - What are the purposes for which RJM makes such disclosures?
Answer: Please see the preceding answer. - What choices and means does RJM offer to individuals for limiting the use and disclosure of their personal data?
Answer: Individuals who have reason to believe that RJM is processing or disclosing their personal data may contact RJM at DPO@rjmgroupllc.com to request that RJM de-identify the personal data prior to any disclosure to third parties. - Is RJM subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC)?
Answer: Yes, RJM is subject to the investigatory and enforcement powers of the FTC with respect to our compliance with the EU-US DPF, the UK Extension to the EU-US DPF, and the Swiss-US DPF. - Under what circumstances may an interested individual invoke binding arbitration involving RJM’s collection and use of personal information?
Answer: There are certain circumstances in which you may invoke binding arbitration against RJM with respect to its compliance with the EU-US DPF, the UK Extension to the EU-US DPF, and the Swiss-US DPF Principles which are set out in Annex I of the EU-US DPF, the UK Extension to the EU-US DPF, and the Swiss-US DPF Principles. For more information about your right to invoke binding arbitration you may contact RJM’s Data Privacy Officer at: DPO@rjmgroupllc.com. In addition, these requirements are further described by JAMS, the independent recourse mechanism selected by RJM and which is made at available at no cost to you. In order to submit a claim with JAMS you must (1) be eligible to file which means that you are either the subject of personal data collected in the European Union / European Economic Area and/or Switzerland or you are the parent or legal guardian of a that data subject in cases where the subject is under the age of 13; (2) allege that RJM failed to comply with the EU-US DPF, the UK Extension to the EU-US DPF, and the Swiss-US DPF Principles in relation to your covered personal data; (3) include credible documentation to support your complaint; (4) supply evidence that you have made a good faith attempt to resolve your complaint directly with RJM; (5) confirm that you have not previously resolved your complaint against RJM through a settlement, court action, arbitration or other form of dispute resolution; and (6) confirm that your complaint against RJM is not the subject of any current litigation or other adjudicatory process. Answer: Yes, RJM is required to respond to lawful requests by public authorities, including to meet national security or law enforcement requirements. - What is RJM’s liability in cases of onward transfers of personal information to third parties?
Answer: As stated previously, RJM does not engage in the onward transfer of personal information to any third party and, therefore, the liability provisions related to such onward transfers do not apply to RJM. If RJM were ever to engage in the onward transfer of personal data to a third party or agent, then RJM would have liability under the EU-US DPF, the UK Extension to the EU-US DPF, and the Swiss-US DPF Principles if its agent processes such personal information in a manner inconsistent with the EU-US DPF, the UK Extension to the EU-US DPF, and the Swiss-US DPF Principles, unless RJM were to prove that it is not responsible for the event giving rise to the damage. - What is my right to access my personal data?
Answer: You have the right to inquire of RJM whether we have any of your personal data and, if so, you may make reasonable arrangements through RJM’s Data Privacy Officer to review that information by contacting us at DPO@rjmgroupllc.com.
- What are my options for electing to limit the use and disclosure of my personal information in RJM’s possession?
Answer: RJM allows individuals whose personal information to limit our use and disclosure of such information. If you wish to arrange for limitations on RJM’s use and/or disclosure of your personal information, please contact us at DPO@rjmgroupllc.com.
GDPR. RJM serves as the data controller for certain personal data used in our clinical studies and the pharmaceutical market research we conduct. As data controller, we do not have possession of your personal data but may have access to anonymized data derived from such personal data.
Most importantly, RJM has adopted this Use and Privacy Policy with the goal of preserving the confidentiality of your personal data. In accordance with personal data protection laws in the United States and in the European Union, you may have the right to access, modify, rectify and delete personal data in our possession or control that relates to you. Children’s privacy language. Because we care about the safety and privacy of children online, we comply with the Children’s Online Privacy Protection Act of 1998 (COPPA). COPPA and its accompanying FTC regulation establish United States federal law that protects the privacy of children using the Internet. We do not knowingly contact or collect personal information from children under 13. Our site is not intended to solicit information of any kind from children under 13. It is possible that by fraud or deception we may receive information pertaining to children under 13. If we are notified of this, as soon as we verify the information, we will immediately obtain parental consent or otherwise delete the information from our servers.
